Updates on DENR Air Quality Policy

DENR-EMB issued Memorandum Circular (MC) 2009-004 last April 1, 2009 amending Annex 2 of MC 2007-003 regarding Policy on Compliance and Permitting for Industrial Facilities Relating to Air Quality. 

MC 2009-004 requires all generator sets with capacity of 1,250 kW or more (classified as large source) operated on stand-by basis be tested for emissions once a year, as opposed to twice a year in MC 2007-03,  with three sampling runs to demonstrate or verify compliance with emission standards. Provided, however, that said stand-by generator-sets does not have the potential to emit more than 100 tons/year of any regulated pollutant under the Clean Air Act. With this new policy, 50% savings on air sampling and analysis cost will be achieved.

Industries are required to submit a computation of stand-by generator-set’s potential to emit any regulated pollutant using actual or previous stack test related to its annual operating hours. The equation is provided in the MC 2009-004.
